Landlord Gas Safety Checks & Landlord Responsibilities

As a landlord, you are responsible for the safety of your tenants. The Gas Safety (Installation and Use) Regulations 1998 deal with landlords’ duties to make sure gas appliances, fittings and flues provided for tenants are safe.

You are responsible for the maintenance and repair of flues, appliances and pipe work which you own and have provided for your tenants use. All work must be carried out by a Gas Safe registered engineer. Although there is no prescribed timeframe for these duties, good practice would be the demonstration of regular, annual maintenance checks and subsequent repairs.

You are also responsible for ensuring an annual gas safety check is carried out within 12 months of the installation of a new appliance or flue which you provide and annually thereafter by a Gas Safe Registered engineer. You must keep a record of the safety check for 2 years and issue a copy to each existing tenant within 28 days of the check being completed and issue a copy to any new tenants before they move in.

A Helpful Checklist for Landlords

As a landlord you’re legally obliged to ensure the safety of your tenants if you have gas appliances in the property. You’re required to have a gas safety certificate, sometimes referred to as a CP12, completed by a Gas Safe™ engineer by law. We’ve produced the checklist below to help you ensure that you’re up to date with safety regulations:

  • Gas safety regulations require a full gas safety check each year on all gas appliances within the property;
  • A copy of the gas safety certificate must be given to your tenant within 28 days of the gas safety check being carried out;
  • All these check must be carried out by a Gas Safe™ registered engineer;
  • If one of your tenants has brought a gas appliance of their own into the property, you’re not responsible for the safety of the appliance itself but you are responsible for the safety of the gas pipes;
  • It is also your responsibility to show the tenants how to turn off the entire gas supply in case of an emergency.
